Terms and Conditions for Commissions
General
I have the right to reject any commission requests for any reason I see fit.
Prices may change depending on demand and personal motivations.
Payment
I accept only USD, and accept payment through Stripe, PayPal, and Venmo for U.S residents. For international orders I prefer Stripe when possible due to better conversion rates and lower fixed fees.
I accept payment 100% upfront or 50% upfront and 50% when finished, preferring 100% upfront. I will not accept 100% when finished.
Do not pay me before I have confirmed your slot.
Process
Maximum resolution and size of the piece will be discussed in the process of requesting a commission.
Commission orders will take around a frame of a week to a month to finish, depending heavily on complexity and revisions, and personal factors such as busyness or health issues.
A finished commission will be sent in both full resolution and a compressed version for web upload and art theft protection.
I currently do not do print services, and any mass print requests for purposes such as merchandise will have to be discussed in contractual terms.
Revisions and Edits
I will send updates of the following stages: Sketch, lineart, base colors and shading, and the final render. I allow for a maximum of three revision requests in the sketch phase, and one revision for the rest of the stages.
Any revisions past the stages or any requests for revision in previous stages after the final render will cost extra fees depending on how much work they are.
References are required, otherwise there will be extra charges due to the needed work of design on my behalf.
Refund Policy
I do not allow refunds once the commission process starts.
If I am unable to get started on your commission after agreeing to a slot, I will give a refund.
Do not use a PayPal chargeback when requesting a refund. I will manually transfer the money to you.
If you request a Paypal chargeback when refunds were not allowed, you will lose all rights mentioned below to the commission and I have the right to use it for my own profit. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you, and you will be blacklisted from requesting commissions from me.
Copyright and Usage Rights
I, Amber Hinkie / FMOptimist, the artist:
Reserve the right to cancel and refund an order at any point for any reason.
Retain all copyrights over all work, including commissioned artwork.
Will not claim the intellectual property of commissioned artwork.
Will not profit further from commissioned artworks unless terms are broken by the customer.
Reserve the right to post commissioned artwork online, use in my portfolio or other showcases that do not directly profit me.
Customers and Clients:
May upload commissioned artwork on any website or social media.
May not make profits from the commissioned piece via reselling, redistributing, uploading to POD-services, make prints, etc.
Do not have the right to alter commissioned artwork without permission from me. This includes processing commissioned artwork through AI tools / programs.
May not resell commissioned artwork.
Retain the rights to the intellectual property.
May not use commissioned artwork for commercial purposes.
The following is considered Copyright Infringement:
Reproducing/using the copyrighted artwork commercially - aka making money off it in any way not specified by terms.
Claiming the artwork as yours.
Altering artwork without my consent in any way.
